Section 377

MSM in India are penalized under Section 377, which can be used against anyone who ‘voluntarily has carnal intercourse against the order of nature’. Anjali Gopalan peaks on the Public Interest Litigation (PIL) filed against section 377 of the Indian Penal Code in the Delhi High Court.

We filed this petition challenging section 377, and asking for reading down of the law in 2001. What we have asked for is consenting adults should not be in the preview of his law. We didn’t ask for getting rid of the law totally because this law is also used for child sexual abuse. So we just asked for the reading down of the law in terms of consenting adults. Right now we are waiting for the final judgment, which we hope to receive any one of these days. I’m hopeful that we did get a good judgment. But till it happens one doesn’t know.
